Nevada Supreme Court blocks attorney fee cap despite only 13% opposition in a Noble Predictive Insights survey

Noble Predictive Insights has announced that nearly two-thirds of Nevada voters support a proposal to cap attorney fees at 20% in civil case victories. This finding emerged from a survey conducted in January, with only 13% of respondents opposing the idea. The announcement was made on X on February 6.

Uber has invested $5 million into Nevadans for Fair Recovery, an initiative advocating for the proposed cap on attorney fees. Uber’s Senior Manager of Public Affairs, Harry Hartfield, said that trial lawyers profit significantly, having spent over $130 million on TV ads in Nevada last year, while clients receive minimal compensation. Supporters of the initiative, including the American Tort Reform Association, argue that the measure aims to curb excessive legal fees and create a fairer system, as reported by Legal Drive.

According to the Las Vegas Defense Group, personal injury attorneys in Nevada typically take 40% of a client’s financial award, in addition to court costs. For a $100,000 settlement, this could leave the plaintiff with just $60,000 before expenses. These high fees have raised concerns about reduced compensation for injury victims and the profitability of contingency-based legal representation.

Assembly Leader Steve Yeager’s Nevada Strong Political Action Committee (PAC) contributed $80,000 to the "Ending Carson City Corruption" PAC and $100,000 to the Citizens for Balanced Leadership PAC. The latter is targeting Republican Lisa Cole in Assembly District 4. According to The Nevada Globe, these donations have raised concerns about political influence and connections to trial lawyer interests.
